EHC plans when detained

On this page you will find information about the statutory requirements for children and young people under the age of 18 who have an EHC Plan and are detained in youth custody.

What are the Statutory requirements?

SEND Code of Practice 2015 says:

Local authorities must not cease an Education, Health and Care (EHC) plan when a child or young person enters custody. This means the local authority must keep this EHC plan, maintain it and review it.

Since 1 April 2015, laws and statutory guidance have been in place that apply to how young people with SEND are supported in youth custody.

These changes were made to improve how support for children, young people, and their families was given.  Requiring services to work together.

This guidance outlines the key requirements and sets out roles and responsibilities locally. For more information you can visit the SEND code of practice (sections 10:60 to 10:150) .
